Course Overview

The emergence of the Principle of Fairness started with the introduction of the Points Based System (PBS) because of the strict nature of the application of the rules and guidance, in what became the hallmark of the new system without discretion or scope for correcting mistakes.

Since 2011 the case law has developed to look at the Home Office’s procedures relating to procedures for correcting mistakes in payments (Basnet et El), mistakes in documents (including secret Home Office policy discovered on FOI request), procedures in interviews and finally the duty of the Immigration Judges.

This course examines the origin of the Principle of Fairness in Common Law and since 2011 the development of the Case Law in the Upper Tribunal of the Immigration and Asylum Chamber.

This is an intermediate and advanced level for lawyers making application and also those doing appeals.
