Course Overview

This course, delivered by experienced private client solicitor and lecturer John Thurston, will offer a practical discussion of variations and disclaimers and will be of interest to solicitors, legal executives and accountants required to advise clients regarding the administration of the estates of deceased persons.

This course will be a useful introduction to those new to this area of private client practice and a refresher to more experiences practitioners who would like to extend their knowledge of the law regarding variations and disclaimers.

What are the requirements?

Learning Outcomes

  • On completion of Part 1 you will:

    • Understand the difference between variations and disclaimers
    • Be familiar with the effect of s. 142 of the Inheritance Act 1975 and s. 62 of the Taxation of Chargeable Gains Act 1992
    • Be able to identify and avoid the pitfalls and traps associated with this area of private client practice
    • Be aware of the Income tax implications in terms of variations and disclaimers

    On completion of Part 2 you will:

    • Be familiar with the uses of variations and disclaimers after the introduction of the transferable nil rate band in connection with the following:
      • NRB
      • BPR and APR
      • Spouse exemption
      • Generation skipping
      • The family home
      • Joint tenancies
      • Charities

About Instructor - John Thurston

John is particularly interested in the law relating to wills, trusts, taxation, powers of attorney and elderly clients.
