Course Overview

Despite the increased use of indemnity insurance policies in conveyancing matters, conveyancers often encounter title defects. The causes of these may include missing or incomplete deeds, poor drafting or errors on the Land Register.

During this course, experienced lecturer Stephen Desmond will consider how to successfully manage common title defects risks and will consider the following questions:

  • When is a right of way defective?
  • What if a property enjoys no rights of access?
  • What are the risks of an injunction being issued in respect of a breach of restrictive covenant?

Learning Outcomes

  • On completion of this course you will:

    • Feel confident when dealing with the Land Registry
    • Have considered the problematic restrictions and plans associated with the Land Registry
    • Be able to identify if and when is there sufficient evidence of an adverse possession claim 
    • Be familiar with the key registration issues with regard to adverse possession
    • Be able to determine when there is a discrepancy between the boundary line and the filed plan
    • Understand the issues involved when a seller is unable to give vacant possession due to occupier failing to moved out

About Instructor - Stephen Desmond

Stephen Desmond has been delivering training for over 15 years during which time he has delivered more than 1,800 CPD events to lawyers from a variety of backgrounds. Delegates at these events have included practitioners from a variety of size of firms, ranging from sole practitioners to City Solicitors. 

Stephen is a contributing editor to Butterworths Property Law Service, published by Lexis Nexis, writing on the complex law relating to long and short leases.  He writes for the Solicitors Group on the subject of commercial property. 
He has run a university-accredited distance-learning course for aspiring paralegals in the subject of residential conveyancing.

A former practicing Solicitor with several years post-qualification experience, Stephen has represented many business and private clients, including property investors and local authorities.
