Course Overview

If advocates are to be successful in court, it is essential that they are familiar the statutory framework governing the disclosure of unused material in criminal proceedings.

This course, delivered by experienced solicitor-advocate Olwen Davies, will guide viewers through the tricky process of making an application for prosecution disclosure under section 8 of the Criminal Procedure and Investigations Act 1996 (CPIA), as amended by the Criminal Justice Act 2003 (CJA 2003). 

Through the examination of extracts from sample skeleton arguments, Olwen will demonstrate how to prepare and present a s.8 application and will provide viewers with useful hints and tips on how to present arguments in practice, whether this be in writing or before a judge.

About Instructor - Olwen Davies

Admitted in 1990, Olwen is freelance solicitor-advocate with extensive experience in both defence and prosecution work from the magistrates' court to the Court of Appeal. Olwen has lectured at post- graduate level and has presented many CPD courses for the legal profession, the police, Health and Safety Executive and others. Olwen is the co-author of Jordan's Criminal Practitioners Guide to the Criminal Justice Act 2003 and is an avid supporter of Save UK Justice and the campaign to stop cuts to legal aid and the criminal justice system.
