Course Overview

The course offers a practical discussion of handling cases in respect of mental health issues in the workplace. Delivered by experienced employment law practitioner and lecturer Ginny Harrison, this course will bring delegates right up to date on the latest cases on mental impairment as a disability.

Given the sensitive nature of such cases, this course will address strategies for client handling for employers’ and employees’ advisers. In addition, this course will discuss tactical considerations for employers’ and employees’ advisers in cases for negotiation and tribunal litigation.

Learning Outcomes

  • On completion of this course you will:

    • Have a good understanding of the law on disability discrimination as it applies to mental health issues
    • Know how to determine if someone with a mental condition has a disability under the Equality Act 2010
    • Be able to recognise when damages are recoverable for mental illness arising in an employment context, including the Court of Appeal decision in FCO v Yapp
    • Understand the tactics and strategy for dealing with clients in these cases and negotiating on their behalf
    • Be aware of the issues which arise at Tribunal in mental impairment cases

About Instructor - Ginny Harrison

Ginny has over 30 years’ experience as a partner in private practice and at a senior level in Government Legal Service. Ginny now runs her own legal consultancy and continues to practise as a solicitor, advising both employers and employees. In addition, Ginny is on the editorial board of the well- regarded Journal of the Employment Lawyers’ Association and has been published herself on a range of employment law topics. Ginny is also a qualified mediator.
