Course Overview

Assessment of costs is a crucial if you are to achieve the most advantageous result for your client. This course will focus on the assessment of inter partes or between party costs namely, summary and provisional assessment and is a must for PI and civil practitioners who handle such cases.

It is no secret that judges dislike summary assessment and will look to avoid them at all costs but the provisional assessment procedure is less than ideal; an assessment by the Judge on paper only, it allows no opportunity for either party to make representations at a hearing.

During this course experienced lecturer Gary Barker will provide and discuss examples of provisional costs assessments and will offer practitioners with useful hints and tips which will improve outcome of these processes better for you, whether you are a receiving party or a paying party.

  • Be familiar with the rules in relation to both forms of assessment, including Practice Direction 44 paragraphs 9.1-6
  • Appreciate how summary assessments operate in respect of interim hearings and fast track trials
  • Know what information must be included within a statement of costs
  • Understand the circumstances in which a provisional assessment will be made, the process involved and the documentation required
  • Be aware of the current issues with provisional cost assessment

About Instructor - Gary Barker

Gary Barker

Gary qualified as a solicitor in 1982 and spent 20 years with two high street practices, specialising in civil litigation and personal injury work. At both firms he took on responsibility for practice development which was to see a fourfold increase in their growth.

He also took on a part-time training role, working for a number of course providers and, with the advent of the Woolf reforms, was soon presenting courses virtually full time.

From 2001 to 2004 he was Head of Practice Development at the Law Society.

Gary is now a practicing solicitor again, which he combines with being a costs consultant and a freelance trainer.

Gary is also an assistant lecturer at the Open University and an occasional contributor to legal discussions on national radio.
